No variation or modification or substitution of these terms by the consumer and no specification of terms by the consumer will wield unless specifically wonted by theVisitorin writing. Ikitchen reserves the right to transpiration or modify its specifications or designs at any time without notice and without incurring obligations. Ikitchen moreover reserves the right to transpiration or modify specifications at any time without prior notice.   ORDERS, PRICES AND PAYMENT a) Quotations remain unshut for visa by the consumer for 21 days without the stage of the Company's quote but theVisitormay vary the contract price to take worth of any increase in materials or other prices between the stage of the customer's order and the stage of delivery. b) Requests for changes to a Kitchen or a products diamond once it has entered production will, if applicable, result in spare charges. c) Cancellation will be considered by the visitor once goods have begun production but the refund of any petrifaction will not include any production financing once incurred or freight. d) ikitchens Product Specification are subject to transpiration without notice. e) Installation financing are specified separately. Goods and Services Tax will be charged in wing to any stated price. f)Wordagecharges within North/South Island New Zealand will be calculated and charged as a separate item.Wordagewill be by a carrier chosen by theVisitorand is non-refundable. g) Payment must be made as follows: • A DEPOSIT of 50% of the contract price must be paid on visa of a quote to initiate production and shall be deemed to be visa of our terms. • THE BALANCE is due surpassing wordage or pick up of any Goods. • Payment may be made by uncontrived banking, wall petrifaction or by cheque. h) Without prejudice to any other rights of whoopee theVisitormay have for late payment by the customer, theVisitormay tuition interest on a daily understructure to the consumer at 12% per annum, until the overdue amounts are paid. Without prejudice to any other remedies, which theVisitormight have, failure by the consumer to pay any debt due will entitle theVisitorto cancel any contracts which theVisitorhas with the customer.   RETENTION OF TITLE a) It is expressly well-set that ownership is reserved and legal and equitable title to and property in all goods supplied or well-set to be supplied by theVisitoris and remains vested in theVisitoruntil payment in full has been received by theVisitorin respect of such goods and all other moneys owing by the proprietrix to the Company. b) TheVisitoris irrevocably entitled at any time and from time to time surpassing sale of any item of goods by the customer, to inspect or to recover and retake possession of such item of goods and otherwise exercise in relation to the goods any of its rights whether those rights are as owner and/or unpaid seller and whether those rights are conferred by worldwide law, contract, statute or in any other way. TheVisitorand its teachers are now irrevocably authorized to enter any premises of the consumer or any third party. TheVisitorand its teachers stipulate to take all reasonable superintendency in removing the goods fitted or installed in such premises but are not liable for any forfeiture or injury to such premises caused by the removal of the goods.   LIABILITY a) Information on specifications, description, measurements and other data often relating to the goods contained in advertisements, catalogues, price lists, illustrations or other similar matter submitted to the customer, while given in good faith, must be regarded only as an injudicious and a unstipulated guide. The consumer acknowledges that it must rely upon its own judgment as to the nature, quality and condition of the goods as to its sufficiency for any use or purpose and the consumer acknowledges that theVisitoris under no duty to unearth the suitability of the goods for any purpose whatsoever. b) In no circumstances will theVisitorbe liable to the customer, or any other person, whether in contract tort or otherwise, for any loss or forfeiture or injury welling directly or indirectly from services or goods supplied by theVisitorto the customer. In any specimen whether theVisitoris found to be liable to the consumer for any reason whatsoever, the extent of the Company's liability will not exceed the contract price. Any warranties or guarantees expressed or unsaid by law or statute are excluded to the extent that any such law or statute permits exclusion. The consumer is not entitled to make any requirement versus theVisitorfor loss of profit, consequential forfeiture or loss, or for forfeiture to any property or injury to any person welling out of a violate of any term or unsaid term of this try-on or under any law or guarantee or warranty given by the Company.   ERECTION BY COMPANY & APPROVALS a) Where theVisitorerects or installs the goods, the consumer must ensure that its use of the goods complies with the law. The consumer is responsible for all fees in connection with complying with any requirements of any local or other authority.   DELIVERY AND RISK a) Any wait in the wordage of goods will not entitle the consumer to cancel the contract or to refuse to winnow wordage or refuse to make payment. If we are unable to replace goods we will offer you the nomination of a credit or a refund. e) The visitor may consider the return of “standard” goods (i.e. not made to order), if you should “change your mind” but if there are any financing involved in doing so, these will be at your expense.   FORCE MAJEURE Should theVisitorbe elapsed in supplying any goods due to any rationalization not reasonably within its control, theVisitormay cancel or suspend the contract without incurring any liability for any loss or forfeiture suffered by the consumer or any other person.   COMPANY'S RIGHT OF CANCELLATION TheVisitormay cancel this try-on if: the consumer does not comply with the provisions of this try-on or any other try-on between theVisitorand the customer; the consumer commits an act of bankruptcy, makes any work or sonnet with its creditors. On the occurrence of any of the whilom events, theVisitormay, by notice in writing to the customer, cancel this try-on without prejudice to any requirement or claims for money due or any violate of this try-on by the consumer surpassing the stage of termination.   CONSUMER LEGISLATION Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the using of the Act, and in the specimen of any conflict, the provisions of that Act will apply.
